Which should be completely irrelevant if she were legitimately assaulted.

It should be, but that doesn't mean that it should be ignored as part of due process, either.

Should it be ignored if he is being deliberately falsely accused? Of course not.

A high-profile defense attorney hired by Pittsburgh Steelers quarterback Ben Roethlisberger on Monday disputed a college student's claim that the two-time Super Bowl winner sexually assaulted her at a Georgia nightclub.

The 20-year-old told police Roethlisberger, who had been out barhopping with friends, assaulted her early Friday. Roethlisberger has not been charged.

"The facts show that there was no criminal activity. No sexual assault occurred," attorney Ed Garland said in a statement Monday. "Ben is completely innocent of any crime."

Milledgeville police said at a press conference that they expect to interview Roethlisberger in the next several days. They said they have not taken a DNA sample from him but probably will.

Authorities also said the woman has hired an attorney, though they would not identify him or her. The woman's name has not been released.

They expect to interview about eight people and said they are reviewing video footage obtained from several businesses. They declined to elaborate.

"The investigation is ongoing. It would be premature to make any announcement at this time," said Fred Bright, district attorney for the Ocmulgee Judicial Circuit. "When the facts are in and a decision is made, we will let you know."

Roethlisberger, who owns a home about 30 miles north of Milledgeville on Lake Oconee, is also being sued by a woman who claims he raped her in 2008 at a hotel-casino in Lake Tahoe hotel and casino, an allegation he strongly denies.

Steelers President Art Rooney II said in a statement Monday that the team is closely monitoring the Milledgeville situation.

"All of us in the Steelers family are concerned about the recent incident involving Ben Roethlisberger in Georgia," the statement said. "We cannot comment on any of the specifics until law enforcement's investigation is concluded."

Garland, Roethlisberger's new attorney, previously represented rapper T.I. on a federal weapons charge and Baltimore Ravens linebacker Ray Lewis in a murder case. More serious charges against Lewis were dropped and he pleaded guilty to a misdemeanor obstruction of justice charge.

The latest accusation came in downtown Milledgeville, about 85 miles  southeast of Atlanta and about 30 miles south of the lake home the  player owns. Roethlisberger, who turned 28 on Tuesday, and two or three  friends went to Buffington's bar earlier Thursday night to watch the  University of Pittsburgh men's college basketball game, said Paul  Kurcikevicus, a 24-year-old college student.

He said the group was friendly, at first joking that Roethlisberger  was not the NFL player. Kurcikevicus said Roethlisberger bought shots  for him and some other people: "O-Bombs," a mixture of energy drink and  flavored rum.

The group later went to The Brick restaurant nearby, owner Frank  Pendergrast said. "He was very polite with everybody," Pendergrast said. "He was down  here from about 11:30 until about 1:30 having a good time, talking to a  lot of people. Looked like he was signing autographs and letting people  take pictures. Other than that, it was really uneventful."
Roethlisberger was later seen at Capital City, a popular nightclub  for students at Georgia College & State University.

One bar patron, 21-year-old college student Brandon Harris, said he  saw Roethlisberger come in with two or three big men who were keeping  other club goers away. Harris said the group went into a curtained VIP  area in the back of the club, and some women were let inside.

Amber Hanley, a 21-year-old college student, said she and a few  friends were also in the VIP area with Roethlisberger. She said she  asked the quarterback to take a photo with her friend, whose boyfriend  was a fan, but he seemed disappointed that's all she wanted. Hanley said  she rolled her eyes, and Roethlisberger called her an expletive and  walked away. Later, Roethlisberger was aggressively hitting on another  girl, Hanley said.

Deputy Police Chief Richard Malone said Roethlisberger had been with  three other people who were mingling with another group that included  the alleged victim. Malone said the woman and her party contacted a  nearby police officer following the alleged assault.

The nature of the assault was not described, but Malone did say it  was being termed a sexual assault.
Roethlisberger and the alleged victim were interviewed and the woman  was taken to a hospital, where she was treated and released, Malone  said. The woman was not identified by police and The Associated Press  does not generally identify possible victims of sexual abuse.

More details are emerging from the more than 500 pages of police documents released on the Ben Roethlisberger case under the Georgia Open Records Act. Among them:

The unnamed woman who accused the Steelers quarterback of sexual assault told police she tried to get away from Roethlisberger in a Milledgeville bar, according to the Pittsburgh Tribune-Review. She also said Roethlisberger came at her with his genitals exposed.

"I told him it wasn't OK; no, we don't need to do this, and I proceeded to get up and try to leave," the accuser said in a written statement. "I went to the first door I saw, which happened to be the bathroom, and shut the door behind him. I still said no, this is not OK, and he then had sex with me. He said it was OK. He then left without saying anything."

No charges were filed against Roethlisberger, who has denied committing any criminal action.  Attorney Lee Parks said the accuser has quit school and is seeking therapy because of the incident.

The Tribune-Review also reports that the officer who wrote that report, Milledgeville police Sgt. Jerry Blash, was under internal investigation for derogatory comments allegedly made about the accuser, and has resigned.

Yea, its too bad he turned out to be a complete tool, because his talent is without question...

two sexual assault allegations within 1 year is a bit much....even for a high profile athlete.  Im curious what the NFL and Steelers will fine him?  2 -4 game suspension without pay??  Didnt LJ get that?

The cop who first investigated Ben Roethlisberger for  sexual assault has "resigned" in the wake of the release of a police  report that shows he may have referred to the accuser as a "f*cking  bitch" ... but TMZ has learned the cop didn't really have a choice.

We're told the Milledgeville Police officer -- Sergeant Jerry  Blash -- turned in his resignation yesterday. He had been with  the force for 8 years.

In the report, investigators claim that  on the night of the alleged incident, Blash admitted that after he  encountered the accuser, he may have made a comment similar to "this  f*cking bitch is drunk" or "this bitch is drunk off her ass accusing Ben  of assaulting her."

Investigators also report that on the night  of the incident, Blash informed the accuser and her friends that  "Roethlisberger has a lot of money" and if the women were to follow  through with a police report, they "would be wasting their time."

Law  enforcement sources tell TMZ Blash was given a lose-lose option --  resign...or be fired.

FYI -- Blash is the same guy who posed for  photos with Ben hours before he was approached by the alleged victim  outside the Capital City nightclub in Georgia.

there are plenty of NFL atheletes hitting up clubs and partying that arent repeatedly getting accused of sexual assault.

If his game is so bad that he has to get written consent, then so be it.

Once you get tagged with that label every gold digger in PA is going to be looking for you at clubs and claiming you assaulted them.  Then everyone who doesn't know crap is going to be out yelling about how it can't all be coincidence.  It's a no win.  He just needs to stay home and hire hookers.

 Now I'm not saying I wouldn't be somewhat star struck myself, but in what freaking world do you sit by as a cop and watch this all go down?
